This Privacy Policy discloses how Brivity, Inc. dba Forward Coaching (“Forward Coaching”, “we”, “our”, or “us”) collects, uses, shares, and protects your Personal Information when you engage with us online or offline, such as when you visit our website (“Site”), download free resources from our Site, register for our events, courses, or trainings, attend an in-person event or training, or contact us directly (collectively, “Offerings”).

  1. How We Obtain Personal Information

Depending on how you interact with us, we may collect information that identifies, describes, or is reasonably capable of being associated with you (“Personal Information”), either directly from you or indirectly through your device or browser when you visit our Site. The following discusses the categories of Personal Information we collect and how we collect your Personal Information.

  1. Information You Provide to Us. For certain activities, such as when you register for an event or course, subscribe to our marketing communications, download free resources from our Site, attend an in-person event, request a complimentary consultation call, fill out a form in-person, contact our sales team, or email us directly, we may collect some or all of the following types of information:
  • Contact information, such as your full name, email address, mobile phone number, mailing address, and social media handle;
  • Username and password;
  • Household or professional information, such as date of birth, gender, professional licenses and qualifications, name of the company you work for, your job title and functions, team size, and sales volume;
  • Payment information, such as credit card information and billing address; and
  • Commercial information, such as your order information, Offerings you use, and your purchasing history with Forward Coaching.
  1. Information We Collect Automatically. We may collect some or all of the following types of information automatically when you use our Offerings:
  • Your Internet protocol (IP) address, cookies, location, browser type, and operating system;
  • Website browsing and interaction activity, pages that you visit before or after using our Site, the date and time of your visit, information about the links you clicked, the pages you view, and the general manner in which you navigate the Site;
  • Responses to advertisements; and
  • Other standard server log information.
  1. How We Use Your Personal Information

We generally use your Personal Information to:

  • Enable you to access and use our Offerings;
  • Operate and improve our Offerings;
  • Contact you about requested Offerings, provide customer service, send transactional messages, and provide you with product and service notifications from our Offerings;
  • Process your payment;
  • Send you promotional materials from us or on behalf of our affiliates or sponsors;
  • Analyze the use of the Site and user data to improve the Site and enhance the user experience;
  • Customize the content you see when you use the Site;
  • Prevent potentially prohibited or illegal activities and otherwise in accordance with our Terms of Service; and
  • Any other purposes disclosed to you at the time we collect your information or pursuant to your consent.
  1. How Long We Keep Personal Information

We keep your personal information only for as long as we need to in order to fulfill the purposes for which we collected the Personal Information and any other purposes permitted by law, in compliance with our data retention policies. For example, we will retain your Personal Information to the extent necessary to demonstrate we have fulfilled our duties or obligations, resolve disputes, and enforce our legal agreements and policies.

  1. Sharing of Personal Information

Forward Coaching may share your Personal Information with companies that are affiliated with us (that control, are controlled by, or are under common control with Forward Coaching.) We may share Personal Information with non-affiliated third parties:

  • In connection with a court order, subpoena, government investigation, or as otherwise required by law, rule, or regulation;
  • In the event of a corporate sale, merger, acquisition, or similar event;
  • Who are service providers that assist in the operation, maintenance, or improvement of the Offerings and the processing of your orders on our behalf, such as our payment processors, web hosts, marketing partners, and technical support resources; or
  • As you otherwise authorize us to share.

Our third party service providers are prohibited from using your Personal Information except to provide the applicable services in compliance with this Privacy Policy and other applicable laws. We do not authorize our service providers to sell any Personal Information we share with them or to use any Personal Information we share with them for their own marketing purposes or for any purpose other than the services they provide for us.

If you have elected to register for one of our sponsored courses or events, or access content or resources from Forward Coaching, we may share your Personal Information with sponsors of the course, event, resources, or content. You agree that these sponsors may use your Personal Information to contact you to provide information about their products or services.

All the above categories exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties.

We may also aggregate data we acquire about you. Non-personally identifiable aggregated data may be shared with third parties for any purpose we determine reasonable and necessary in our sole and exclusive judgement and discretion.

  1. Notice of Financial Incentive

From time to time, we may offer financial incentives to promote our Offerings. These financial incentives may include discounts, coupons, and one-time promotions when you sign up for our email list, participate in a marketing promotion, or create an account. Such offers may not be available at all times.

Sometimes, we may ask you to provide personal information in connection with these promotions. Participation in any financial incentive program is optional. You may withdraw from the program at any time by emailing datasupport@forwardcoaching.com.

The value of any financial incentive we offer is reasonably related to the value of any personal information you provide to us. Our good faith estimate of the value of your personal information is the value of the benefit we offer to you. We have calculated such value by using the expense related to the benefit. By participating in any of our promotions, you agree that the benefits are reasonably related to the value of the personal information collected and retained.

Please note that we may provide additional terms that apply to a particular financial incentive. If applicable, those terms will be presented to you at sign up.

  1. Personal Data of Children

Our Offerings are intended for users who are 18 years or older. We do not knowingly receive, process, store, or otherwise use the Personal Information of children under 13 years of age. If we become aware that we have collected information from a child, we will delete such information from our records. If you are a parent or legal guardian and believe your child has given us information and you did not provide consent, please contact us at datasupport@forwardcoaching.com.

  1. Our Cookie Policy

Forward Coaching may use the standard cookie feature of major browser applications and third party providers, including Google Analytics features (Remarketing, Google Display Network Impression Reporting, the DoubleClick Campaign Manager Integration and Google Analytics Demographics and Interest Reporting), or employ internally developed cookies, clear GIFs, pixel tags, tracking codes, and other technologies that allow us to store a small piece of data on your computer, or any other device used to access our Offerings, about your visit to the Site or use of our Offerings. You can remove persistent cookies by following directions provided in your Internet browser’s “help” directory. If you reject cookies, you may not be able to use or benefit from all of our available Offerings.

  1. Do Not Track

Some internet browsers offer a “Do Not Track” feature. When enabled, your browser sends a signal to the sites you visit directing the sites not to track your activity. Presently, our Site does recognize “Do Not Track” signals.

  1. Request for Disclosure. No more than twice in any twelve-month period, you may request that Forward Coaching disclose the following for the prior twelve months:
  • The categories and specific items of personal information that we have collected regarding you;
  • The sources from which each category of information was obtained;
  • The business purpose for which each category of information was collected;
  • The categories of third parties with whom we have shared Personal Information; and
  • The business purpose for which your Personal Information was shared.
  1. Request for Copy of Personal Information. You may request that Forward Coaching provide you with a copy of your Personal Information. To the extent possible, we will provide your Personal Information in a portable, readily usable fashion.
  1. Request for Deletion of Personal Information. You may request that we delete your Personal Information from our records by contacting us at datasupport@forwardcoaching.com. Upon a deletion request, we will instruct any third parties with whom we have shared your Personal Information to delete your Personal Information from their records. If you exercise your right to request the deletion of your Personal Information, we may not be able to provide our Offerings to you. Notwithstanding a request to delete your Personal Information, we may retain your Personal Information, in whole or in part, for the purposes of completing ongoing transactions, maintaining an ongoing business relationship, or complying with applicable laws, rules, and regulations.
  1. Request to Correct Personal Information. You may request that we correct inaccurate Personal Information that we maintain about you. If you created an account with us, you may update your Personal Information by logging in and editing information through your account settings.
  1. How to Exercise Your Rights. You may exercise your rights described herein by contacting us at datasupport@forwardcoaching.com. Before processing your request, we may need to verify your identity or authority to make the request, in which case we may request additional information from you.
  1. Non-Discrimination. You have the right to be free from discrimination based on your exercise of any rights described herein.
  1. Opting Out of Marketing Communications. You may stop receiving promotional email messages and SMS messages by following a link contained in the message itself or replying “STOP”. Please note, if you opt out of receiving our marketing communications, we may continue to contact you regarding service-related issues.
  1. Do Not Sell or Share My Personal Information. We do not sell your Personal Information to third parties for monetary value. However, we may share or disclose Personal Information to affiliates or third parties in such a way that may be considered “sale” or “sharing” in certain jurisdictions. You may opt out of the selling or sharing of your Personal Information by contacting us at datasupport@forwardcoaching.com, or by clicking the California Consumer Privacy Act link at the bottom of the webpage and selecting “Do Not Sell or Share My Personal Information”.
  1. Data Storage and Access

Forward Coaching shall endeavor and take every precaution to maintain adequate physical, procedural, and technical safeguards with respect to its offices and information storage facilities so as to prevent any loss, misuse, unauthorized access, disclosure, or modification of your Personal Information under our control. All Personal Information collected by us will be stored and accessed in the United States.

Nothing in this Privacy Policy restricts Forward Coaching’s ability to:

  • Comply with federal, state, or local laws and regulations;
  • Comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities;
  • Cooperate with law enforcement agencies concerning conduct or activity that the business, service provider, or third party reasonably and in good faith believes may violate federal, state, or local law;
  • Exercise our rights or defend legal claims;
  • Detect security incidents and protect against fraudulent or illegal activity and prosecute those responsible for such activity; or
  • Transfer Personal Information as part of a merger or acquisition, dissolution, or in the event of bankruptcy or any other transaction in which a third party assumes control of all or part of Forward Coaching.

Our Offerings may contain links to other websites and services. The fact that we link to a website or service is not an endorsement, authorization or representation that we are affiliated with that third party. We do not exercise control over third party websites or services and are not responsible for their actions. Other websites and services follow different rules regarding the use or disclosure of the Personal Information you submit to them. We encourage you to read the privacy policies or statements of the other websites you visit and services you use.

We may update this Privacy Policy to reflect changes to our information practices. If we make any material changes, a notice may be posted on this page along with the updated Privacy Policy prior to the change becoming effective. We will not use or share your Personal Information for materially different purposes without first taking reasonable steps to provide you with notice.
